EcuadorTrails, which will be referred as ´The Agency´ from now on, offers the usage of this website to all users, conditioned to the acceptance of its terms and conditions described here.

The user declares to be 18 year old or older and it is able to agree in the usage of this site according with its terms and conditions, the user understands them fully. The user is responsible of treating confidentiality and guard properly the information provided by the agency to access the site (see privacy policy). 

The user accepts to be responsible of the economic consequences derived from the use of the site that can be produced for the use of its information, either by him or by third parties. The user also states that the information provided by him to access the site and during its usage, its true, complete and accurate. The user commits to keep the information updated. 

This site exclusively for the personal use of the user. Any form of modification, reproduction, duplication, copy, distribution, sale, resale or others forms of exploitation, either for commercial purposes or without them. The user agrees not to use this site for illegal or prohibited purposes.

Particularly, the user will use the site only for himself and the products and services acquired on the site will be destined for himself or people that he is legally authorized to act upon. The user will not resell the products or services purchased on this site to others.

EcuadorTrails is a registered brand and this website www.ecuadortrails.com and https://ecuadortrails.tours are owned and managed by Rene Erazo, who as a private citizen living in the country of Ecuador and a citizen with a business identification number 1718292657001, It operates in the field of preparation and marketing of tourism services accessories, such as excursions, guided tours, private tours, tastings, etc. It performs its business primarily through the internet. The terms and conditions described here apply to all services, cruises, programs or  any third-party program or services sold or arranged by EcuadorTrails in this website.

Acquisition of products and services through the website

The user of the site has access to information about products and services related to tourism and traveling, in this cases, the user can make reservations and buy those products and services through the site. The bookings and purchases of the user are subjects to this terms and conditions. The user has to accept the terms and conditions established by any supplier the agency wishes to hire; including and without limitation to the payment of any accrued amounts and compliance with any rules and restrictions regarding the availability of rates, products or services. In the case that there could be any special rules or restrictions that could affect the fare of the service or product selected by the customer, the user already accepts them.

The service providers each within the scope of their respective obligations, they will be liable to the User for compliance with the obligations derived from the regulations to the date of the delivery of the service. The providers will also be responsible of the terms and conditions of sale of each product or service offered by them, the Agency does not have responsibility over the products or services that are not delivered by them directly.

Cancelation/Refund Policy

  1. If the cancellation is total or due to a decrease in the number of passengers in the reservation made within 90 to 30 days before the date of the tour service, 20% will be charged.
  2. If the cancellation is total or due to a decrease in the number of passengers in the reservation made within 29 to 16 days before the date of the daily navigable tour service, 50% will be charged.
  3. If the reservation is canceled 15 days before the contracted date for the tour service, a 100% penalty will be charged.
  4. If the passenger does not show up on time on the day of the tour service or decides not to take the tour, there will be no refund of the canceled amounts.
  5. Any cancellation must be requested via email to the following e-mail: tours@ecuadortrails.com, and the agency or tour operator making the request must have the acceptance of EcuadorTrails in writing via email.

Industrial and intellectual property rights

All contents on the site are exclusive and property of Ecuador Trails, which is a registered brand itself protected by national and international industrial and intellectual property regulations given by the IEPI (Ecuadorian Institute of Intellectual Property).

Limitation of liability

Ecuador Trails presents this site as it is and makes the greatest efforts to update, maintain and operate it, not being able to guarantee the absence of technical failures, the infallibility of the service, or that the system or portal is operative at all times. Ecuador Trails provides through its website different information about products and services provided by third parties, so it can not assume any legal responsibility for the lack of veracity, accuracy and / or updating of the information contained in the product offers, or services offered on the Website which are operated by the different suppliers of products and / or services.

Travel agents, their proprietors, organizers, representatives, and staff primarily serve as intermediaries for proprietors, contractors, and providers offering transportation and/or other associated travel amenities. They generally bear no liability for injury, loss, or damage to individuals or belongings stemming directly from unforeseen circumstances, such as acts of nature, detentions, inconveniences, delays, expenses due to quarantine, labor strikes, thefts, force majeure events, conveyance failures, civil disruptions, terrorism, governmental restrictions or rules, and discrepancies or modifications in transit or lodging services outside their control.

Amendments to the itinerary may occur if deemed necessary for the passengers’ comfort and welfare, adhering to the regulations of the Galapagos National Park. Typically, the prerogative remains to substitute boats for others departing on the same date, with an equal or superior class, modify the itinerary, or change the sequence of planned destinations. By submitting a deposit to an agent, the depositor thereby agrees to adhere to the aforementioned terms and conditions.

Ecuador Trails is excluded from any legal liability derived, from those deficiencies, defaults and changes on services or itineraries.

The Agency’s website may contain links to other websites not managed by us, which are included for reference purposes only. Ecuador Trails does not exercise any control over those websites, nor is it responsible for its content. The inclusion of links to other websites does not imply that the agency promotes, endorses, guarantees or recommends them. Such links are only offered as informative references, without any kind of assessment of its contents, owners or services or products offered from them.

Law and applicable jurisdiction

The Users voluntarily renounce their jurisdiction and competence and agree to submit any dispute for reason or on the occasion of relations with Ecuador Trails to the resolution of an Arbitration Court of the Camara de Comercio de Quito that will be subject to the provisions of the Law of Arbitration and Mediation, the Regulation of the Arbitration and Mediation of the Camara de Comercio de Quito and the following rules: (i) The arbitrators will be selected in accordance with the provisions of the Arbitration and Mediation Law; (ii) The parties renounce to the ordinary jurisdiction, agree to abide by the award issued by the Arbitral Tribunal and to not undertake any type of appeal against the arbitration award; (iii) For the execution of precautionary measures, the Arbitral Tribunal is empowered to request the assistance of judicial police and administrative public officials without recourse to any ordinary judge; (iv) The arbitral tribunal will consist of three arbitrators; (v) The arbitration procedure will be confidential; (vi) The place of arbitration will be at the facilities of the Arbitration and Mediation Center of the Camara de Comercio de Quito; and, (vii) The arbitrators will decide in law according to Ecuadorian legislation.
